You may not modify, copy, transmit, sell or distribute in whole or in part of this website except that EverAI grants you not-exclusive, non-commercial, limited use of this website. You may not use any part or a whole of this website in order to create a part of new website and/or when you use even links on the Internet to create it without EverAI’s prior written consent. Notwithstanding the foregoing, any software and other materials that are made available for downloading, access, or other use from this site with their own license terms, conditions, and notices will be governed by such terms, conditions, and notices.

6. Liability Limitation

You understand and agree that you use the website at your own discretion and at your sole risk. You understand and agree that, in no event, EverAI, EverAI and all of its affiliates will be liable to you or any party on all harms and damages (including direct and indirect damages, special damages or consequential damages of any type whatsoever) related to or arising from the use of our website, even if EverAI is experssly advised of the possibility of such damages. By using our website, you will be solely responsible for:

Any loss or injury caused, in whole or in party, by its actions, omissions, or negligence, or for contigencies beyond its control, in procuring, compliling or delivering or the posted information in this website;

Any errors, omissons, or inaccuracies in the information regardless of how caused, or delays or interruptios in delivery of the information; or Any download or otherwise obtain materials, information, products, software, programs thay may result, including loss of data or damage to your computer system. 7. Violation & Service Termination

If you violate these Terms, applicable laws, or our Privacy Policy, EverAI reserves the right to suspend or terminate your access to the website and services, at its sole discretion, without notice

8. Choice of Laws

These Terms of Use and provisions stated herewith will be governed by and construed in accordance with the laws of Socialist Republic of Vietnam, without giving effect to its conflict of laws provisions or your actual country, territory of residence. Any claims, legal proceeding or litigation arising in connection with these Terms of Use will be brought solely in Vietnam, and you consent to the jurisdiction of such courts.

9. Voice Cloning Service

9.1 Ownership of Cloned Voices

You retain ownership of your original voice data. By using the voice cloning feature, you grant EverAI a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and adapt your voice data to create and provide the cloned voice, and to improve our services. EverAI will not sell or share your original voice data with third parties without your explicit consent, except as outlined in our Privacy Policy.

9.2 User Responsibilities

You are solely responsible for the use of your cloned voice. You agree not to use the cloned voice for any illegal, unethical, or harmful purposes, including but not limited to those listed in the "Prohibited Conduct" section.

9.3 Consent and Verification

If you upload voice data of a third party, you represent and warrant that you have obtained all necessary consents and permissions from that individual to use their voice data for cloning purposes. EverAI may require you to provide proof of such consent.

9.4 Limitations of Voice Cloning

The quality of the cloned voice depends on the quality and clarity of the audio sample you provide. EverAI does not guarantee a perfect replication of the original voice.

10. Prohibited Conduct

You are strictly prohibited from using the Services for any of the following purposes:

10.1. Unlawful Activities and Content:

• Undermining the State of the Socialist Republic of Vietnam; harming national security, social order, and safety; undermining national unity; disseminating propaganda for war or terrorism; inciting hatred or conflict between peoples, ethnic groups, or religions. (This directly reflects the Vietnamese law provision.)

• Promoting or inciting violence, obscenity, depravity, crime, social evils, superstition, or undermining the fine customs and traditions of the nation. (This directly reflects the Vietnamese law provision.)

• Disclosing state secrets, military secrets, security secrets, economic secrets, foreign affairs secrets, or other secrets as prescribed by law. (This directly reflects the Vietnamese law provision.)

• Disseminating false, defamatory, or slanderous information that harms the reputation of organizations or the honor and dignity of individuals. (This directly reflects the Vietnamese law provision and is a common international standard.)

• Advertising, promoting, or trading in prohibited goods or services; disseminating prohibited press works, literature, art, or publications. (This directly reflects the Vietnamese law provision.)

• Impersonating organizations or individuals and disseminating false or misleading information that infringes upon the legitimate rights and interests of organizations or individuals. (This directly reflects the Vietnamese law provision and is a common international standard.)

• Defaming, coercing, humiliating, abusing, harassing, threatening, deceiving, impersonating, or menacing any individual or organization. (Added detail for clarity on personal attacks.)

10.2. Interference with Lawful Access and Services:

• Illegally obstructing the provision and access of lawful information and the provision and use of lawful services on the Internet by organizations and individuals.

10.3. Interference with Systems:

• Illegally obstructing the operation of the Vietnamese national domain name system ".vn" or the lawful operation of systems providing Internet services and online information.

10.4. Unauthorized Access and Use:

• Using passwords, encryption keys of organizations or individuals, private information, personal information, and Internet resources without authorization.

10.5. Malicious Software and Hacking:

• Creating illegal links to the legal domain names of organizations or individuals; creating, installing, or distributing malware, computer viruses; illegally accessing or taking control of information systems; or creating tools for Internet attacks.

10.6 Intellectual Property Infringement:

• Infringing on the copyright, intellectual property rights of any organization or individual.

10.7. Other Prohibited Acts:

• Any other acts prohibited by the laws of Vietnam.

10.8. Additional Prohibitions Specific to Voice Cloning and Text-to-Speech Service:

• Using the Service to generate "deepfakes" or impersonate any individual without their express, verifiable consent.

• Generating content that is sexually suggestive, exploits, abuses or endangers children.

• Circumventing any security measures of the service.

• Generating content for the purpose of spreading misinformation or disinformation.

• Using the service to generate content which violates any third party's copyright, trademark, privacy, or other intellectual property rights.

• Any attempt to reverse engineer, decompile, or otherwise extract the source code or underlying models of the Service, except to the limited extent permitted by applicable law.

• Creating an excessive number of requests that could be deemed as spamming or an attempt to disrupt service for other users.

12. Changes to These Terms of Use

EverAI reserves the right, at its sole discretion, to modify or terminate this service at any time, for any reason, without prior notice. You are responsible for regularly reviewing these terms. Your continued use of this website constitutes your acceptance of all such terms.
